    1. Penal Code 273.5 – domestic violence charge.

    3. Penal Code 666 – petty theft with a prior. This charge can either a misdemeanor or a felony, depending on how the district attorney wants to file on it.  
    4. Penal Code 245(a)(1) – assault with a deadly weapon
    5. Health and Safety Code 11550 – under the influence of a controlled substance, this has nothing to do with driving or even being in public.
      •  This law simply makes it illegal to be under the influence of a controlled substance, even when sitting in your home. 
      • Marijuana is not considered a controlled substance for purposes of this statute. 
      • This charge is often brought in conjunction with DUI charges. It is fairly common for an individual arrested on a DUI to take a blood test, have a controlled substance appear, and also face this additional charge. 
      • This charge comes with a mandatory minimum of 90 days. Generally Penal Code 1000 diversion is a possibility.
    6. Health and Safety Code 11359 – Possession of marijuana for sale. Felony charge with a mandatory prison sentence if probation is not granted.
