    1. Penal Code 273.5 – domestic violence charge.
      • Strictly a felony offense with prison if no probation granted.
    2. Penal Code 484 – petty theft, generally can be disposed of with some type of diversion program.
      • Misdemeanor Offense
    3. Penal Code 666 – petty theft with a prior. This charge can either a misdemeanor or a felony, depending on how the district attorney wants to file on it.
    4. Penal Code 245(a)(1) – assault with a deadly weapon
    5. Health and Safety Code 11550 – under the influence of a controlled substance, this has nothing to do with driving or even being in public.
      •  This law simply makes it illegal to be under the influence of a controlled substance, even when sitting in your home.
      • Marijuana is not considered a controlled substance for purposes of this statute.
      • This charge is often brought in conjunction with DUI charges. It is fairly common for an individual arrested on a DUI to take a blood test, have a controlled substance appear, and also face this additional charge.
      • This charge comes with a mandatory minimum of 90 days. Generally Penal Code 1000 diversion is a possibility.
    6. Health and Safety Code 11359 – Possession of marijuana for sale. Felony charge with a mandatory prison sentence if probation is not granted.

This list represents only a small portion of criminal defense, although they are some of the more common. For information on how to defend you criminal case, contact DUI Defense Attorney Michael Rehm at (650) 293-9070 for a free consultation.
